Can Foreigners Buy Property or Land in Uganda?

Foreign nationals can acquire property interests in Uganda, but Uganda's land laws place important restrictions on the type of land tenure that non-citizens may hold.

Important for International Buyers

Under Uganda's Land Act, a non-citizen may acquire a lease in land, but generally cannot acquire or hold freehold or mailo land. A lease granted to a non-citizen cannot exceed 99 years.

This makes the legal structure of a proposed property transaction especially important for foreign buyers. Before paying a deposit or signing an agreement, the tenure, registered ownership, proposed interest and transaction documentation should be properly assessed.

01 Can foreigners buy property in Uganda?

Yes, foreign nationals can acquire property interests in Uganda, but the type of land tenure available to a non-citizen is restricted by Ugandan law.

A foreign buyer can generally acquire a leasehold interest in land. Ugandan law does not generally allow a non-citizen to acquire or hold freehold or mailo land.

This means that a foreign buyer should not evaluate a property transaction only by looking at the house, apartment, commercial building or land being offered. The underlying land tenure, ownership, lease terms and title documentation must also be understood.

02 Can foreigners own land in Uganda?

Foreign nationals cannot generally own Ugandan land under freehold or mailo tenure. However, Uganda's Land Act allows a non-citizen to acquire a leasehold interest in land.

A lease gives the holder rights over the property for the agreed period, subject to the lease terms and applicable Ugandan law. For foreign property investors, understanding the remaining lease period, conditions of the lease and registered ownership is therefore extremely important.

The law also treats certain companies as non-citizens where controlling ownership or decision-making lies with non-citizens. Therefore, simply incorporating a company in Uganda does not necessarily remove the foreign land ownership restrictions.

03 Can a foreigner own freehold land in Uganda?

Generally, no. Uganda's Land Act provides that a non-citizen may not acquire or hold freehold or mailo land.

Foreign nationals are generally permitted to acquire leasehold interests instead. For this reason, a property advertised simply as "freehold land for sale" should not automatically be assumed to be directly transferable to a foreign buyer in the same form.

Before proceeding, the existing tenure and proposed transaction structure should be reviewed so that the buyer understands exactly what interest they can lawfully acquire.

Be cautious if anyone tells you that registering a Ugandan company automatically allows a foreign-controlled company to own freehold land. Ugandan land law contains specific rules determining when a corporate body is treated as a non-citizen.

04 How long can a foreigner lease land in Uganda?

Under Uganda's Land Act, a lease granted to a non-citizen cannot exceed 99 years.

A foreign buyer may therefore acquire a long-term leasehold interest, depending on the property and transaction. The actual lease being offered may, however, be shorter than 99 years.

Before acquiring leasehold property, the buyer should verify the original lease term, commencement date, remaining period, registered proprietor, conditions, ground-rent obligations and any registered interests affecting the land.

06 Can MWSAU verify a land title in Uganda?

Yes. MWSAU can help coordinate land and title verification as part of property due diligence in Uganda.

Uganda's land-registration system provides official search procedures through which information concerning registered land can be checked. Depending on the title, information such as county, block and plot details or volume and folio information may be needed to conduct the relevant search.

A title search is an important part of due diligence, but it should not always be the only check. Depending on the transaction, additional verification may involve the physical property, boundaries, seller identity, supporting documents, occupation of the land and other material circumstances.

07 How do I verify who owns land in Uganda?

For registered land, an official search through Uganda's land-registration system can help establish information recorded against the relevant title or parcel.

The Ministry of Lands' land information system supports searches using the identifying details of a title or parcel, such as county, block and plot information or volume and folio details where applicable.

However, confirming a name on a title should not automatically end the due-diligence process. A prudent buyer may also need to confirm the identity and authority of the seller, inspect the physical property, consider registered interests or restrictions, review transaction documents and investigate any material inconsistencies.

08 What should I check before buying land in Uganda?

Before buying land in Uganda, a purchaser should consider both the legal documentation and the physical reality of the property being offered.

Depending on the transaction, important checks may include the land tenure, registered proprietor, title or parcel information, seller identity, authority to sell, location, boundaries, occupation, registered interests, lease terms and any material disputes or inconsistencies.

The buyer should also understand what documentation will be required for the transaction and transfer process and, for a foreign buyer, whether the proposed land interest can lawfully be acquired under Uganda's non-citizen land ownership rules.

09 Can MWSAU investigate a seller or property agent?

Yes. Where there is a legitimate property transaction or due-diligence purpose, MWSAU can conduct lawful verification concerning a seller, agent, developer or other party involved in the transaction.

Depending on the circumstances and information lawfully available, checks may include identity and business verification, company information, physical business or property-location checks, review of material documents and investigation of claims made about the transaction.

This can be especially valuable where an international buyer has only communicated with the seller or agent remotely and is being asked to send money before meeting them or inspecting the property.

The scope of any investigation is agreed in advance and carried out using lawful and appropriate methods.

10 Can you help if I have already found a property?

Yes. You do not need to use MWSAU to find the property in order to use our verification and transaction-support services.

If you have already found land, a house, apartment, commercial building or other property in Uganda, send us the available property details and documents.

11 Can I buy property in Uganda while living abroad?

Many parts of a Ugandan property search and transaction can be coordinated while the client is outside the country, although the exact requirements depend on the property and transaction.

MWSAU can begin remotely by discussing your requirements, sourcing or assessing property, receiving available documents, coordinating verification and providing local follow-up.

Where formal documents need to be signed or actions need to be taken on your behalf, appropriate legal authorization, such as a properly prepared power of attorney, may be considered depending on the circumstances.

12 Can MWSAU physically inspect property on my behalf?

16 What documents should I request from a property seller in Uganda?

The appropriate documents depend on the property, land tenure and transaction. However, buyers should generally obtain sufficient information to establish what property is being offered and whether the person offering it has authority to transact.

Relevant information may include identification details of the seller, available certificate-of-title or lease information, plot or parcel particulars, transaction documents, ownership or company documents where a corporate entity is involved and any documents supporting the seller's authority to act.

If someone is acting on behalf of the registered owner, the authority under which that person is acting should also be properly examined.

Rather than relying only on photocopies supplied by a seller or agent, important information should be independently verified through appropriate official and professional channels.

17 How long does property verification take in Uganda?

The time required depends on what needs to be verified. A basic official land-registry search is different from comprehensive property due diligence involving physical inspection, seller verification, surveying, document review or investigation of a possible dispute.

Current Ministry of Lands service standards indicate that a physical or personal search on registered land may have a standard service time of approximately one working day, while issuance of a search report or letter may take approximately two working days.

A complete MWSAU property-verification assignment may take several working days or longer depending on the location, documents available, scope of due diligence, responsiveness of relevant parties and whether additional professional checks are required.

After reviewing the property details, we can provide an estimated scope and timeframe for the specific assignment.

18 Can MWSAU help with surveyors and legal professionals?

Yes. Property transactions can require professional expertise beyond general property sourcing or verification.

Where appropriate, MWSAU can coordinate with qualified legal practitioners, surveyors, valuers and other relevant professionals for work within their respective professional responsibilities.

A surveyor may be appropriate where boundary, acreage or technical land-survey questions need to be examined, while a lawyer may be required for legal due diligence, transaction documentation, conveyancing or representation.

19 What are the risks of buying land without due diligence in Uganda?

Buying land without appropriate due diligence can expose a purchaser to serious financial and legal problems, particularly where significant money is transferred before ownership and transaction information has been independently checked.

Potential issues can include dealing with someone who lacks authority to sell, discrepancies between the land shown and the land documented, undisclosed registered interests, boundary problems, conflicting claims, problematic transaction documents or other material inconsistencies.

Foreign buyers face an additional consideration because the type of land interest they can lawfully hold in Uganda is restricted. The proposed tenure and acquisition structure should therefore be examined before completion.

Due diligence cannot guarantee that a property transaction will never encounter a problem, but careful verification can identify important issues before a buyer commits substantial funds.
